Can a collection agency place a levy on a checking account in Texas? I am being sued by a collection agency and I was served me with a petition stating that if I dont pay the balance ($4000), they are going to file a "default judgement" against me. I have 20 days to reply, or I have to go to court. I know that my home (which is paid for) is considered a "protected asset" and is exempt, but how about my checking account? My total income is SSI ($674 a month), and its barely enough to pay my utility bills with a small amount leftover. I am 61, and disabled, and have not worked in 4 years. I will never be able to work again. Can they put a "levy" on my checking account and freeze it or take what small amount I have? Is that legal in the state of Texas? I am unable to pay to file for bankruptcy, so all I can do is wait and see what they do to me. I'm very worried about this. Any information would be greatly appreciated. Thank you in advance.
