I disagree with you both.
On the job harrassment is legal grounds for a lawsuit if the harrassment impaired the person's ability to perform his/her job or resulted in termination.
I suggest talking to an attorney before taking any other actions.
The search for people who can answer your question continues for as long as needed - until you find the answer you were looking for.
