I was hit with a OUI in WI. I was not driving and a police officer thought I was drinking, and took me to their PD for a breath test. They purposely had me wait 45-50 minutes after 1st police contact, and an officer finally first tested me on the breath machine. No air was blown into the machine, and the results did not take. The testing officer then signed both as the Operator of the testing machine, and that of the Witness viewing the test. ?
I then was taken to have a blood test. A sample was taken, which was a full 90 minutes after the 1st police contact, and the sample ended out being above the legal limit.
Any Advise? What legally can I say to the courts to turn the law back on them, because the test results are/were not really accurate nor the same as when the officer 1st came up on me, 90 minutes prior?
It seems they were purposely "boiling" and increasing my BAC count so it would register higher, for a more easy conviction... Any help/advise would be greatful..
