I have heard a brief discussion about this a while back. If I remember correctly, you must send a registered letter to your neighbor expressing concern for possible damage. I think if you do this, you should be able to collect damages.

Keep a copy of the letter. You might want to include a picture of the tree. Be sure to do the "Enc.:picture of your tree" at the bottom of the letter.
