east point, ga. There is a tree about 85 fet tall. It is on property A. Sone of the limbs are hanging on property B. If a limb falls from property A and damages a car on property B, is property A at fault? There are several trees on both properties that are this tall. Is there such a things as air rights - meaning if a limb did fall from property A unto property B,but beause the trees are so tall, would property A not be liable to property B? What law would be used for this situation.

I have heard a brief discussion about this a while back. If I remember correctly, you must send a registered letter to your neighbor expressing concern for possible damage. I think if you do this, you should be able to collect damages.

Keep a copy of the letter. You might want to include a picture of the tree. Be sure to do the "Enc.:picture of your tree" at the bottom of the letter.
